We pursue complaints, judicial review and claims under the Human Rights Act on behalf of vulnerable clients. We have a particular expertise in children’s rights including the rights of locked-up children, looked-after children and unaccompanied refugees.

We also pursue public law remedies for other clients of the firm. We are particularly interested in arrangements for release and resettlement of the detained particularly where care in the community services are, or should be, involved.

Mental Capacity Act 2005

The Mental Capacity Act 2005 came into force on 1st October 2007. It provides for a Lasting Power of Attorney (LPA), to enable individuals to make arrangements to deal with their finances, property, and personal welfare in the event that they lose capacity to do so themselves. We offer advice and assistance in drawing up, executing and registering LPA’s. We can also advise on and draft advance decisions to refuse medical treatment (living wills). We can advise on other funding options.

The act also provides protections for those deprived of their liberty in order to receive care or treatment. The Deprivation of Liberty Safeguards (DOLS) apply to anyone aged 18 and over who does not have the mental capacity to give informed consent about their care or treatment.

The safeguards are intended to prevent arbitrary decisions which deprive vulnerable individuals of their liberty unnecessarily and to ensure people can get the care they need in the least restrictive way. Individuals have a right to challenge decisions that impose unlawful detention. We can advise and help with such cases. Legal aid, subject to eligibility criteria, is available. We act for clients in England and Wales, including London, Kent, Nottingham, Manchester and Birmingham.
