How we fight your corner in medical cases – Part 1

Scott-Moncrieff has some of the best clinical negligence solicitors in the country, but winning a medical case is not simply a question of being a good solicitor.  No matter how good we are, we must use all the weapons at our disposal to get the right result for you.

Here, we explain the efforts Scott-Moncrieff’s clinical negligence team goes to while ensuring your case has the best chance of winning.

The first thing to emphasise is that if you, or a loved one, ends up with an injury as a consequence of medical treatment, that does not always mean that the clinician was at fault.  We must show much more than that.

For instance, even if a doctor did make the wrong decision, a court can sometimes decide that he or she was not negligent because they followed the correct procedures and simply did what other reputable doctors might have done in the same circumstance.  So they could be found not to be at fault.

On top of that, we have to show that the negligence actually caused the injury. Sometimes there was negligence but it had nothing to do with your injury.

How do we set about winning your case?

You

We always start with you, our client.  We ask you to tell your story and we find out from you - in as much detail as possible - what happened or what didn’t happen; what conversations took place; what advice was given and so on.

A lot of people worry that if it is their word against a doctor they are bound to lose, but that is not necessarily the case.  What happens when you receive medical treatment is unique to you: your experience and your body belong to no one else.  On the other hand, a clinician might be dealing with hundreds of people throughout the year and he or she will seldom remember individual incidents.

That is why it is so important for us to hear your version of events at an early stage in a case.  If the case proceeds, this will be your evidence.  Evidence is what wins cases.
