Mark is an experienced consultant solicitor with a broad commercial practice, advising businesses, insolvency professionals and high-net-worth individuals on complex legal and commercial matters. He has a management and legal background, and was Joint Managing Partner and an equity partner at his own practice for more than 10 years. Following a five-year period working in property development, renewable energy, asset management and planning, he has now set up his own practice with Scott-Moncrieff, where he practises on a part-time basis.

As a general commercial practitioner, Mark can consider disputes and transactions in their wider context, particularly where issues involving contracts, business ownership, property, insolvency and personal liability overlap.

He regularly advises on commercial disputes, contractual claims, shareholder and business ownership matters, director duties and fiduciary responsibilities, and issues arising from the management or breakdown of business relationships. His work also includes commercial property matters – including collateral warranties and the disputes, assignments and replacement by the alternative procedure that arise in connection with them – and disputes involving valuable business or personal assets.

A significant part of his practice involves contentious insolvency and restructuring. He acts for insolvency practitioners and other professional advisers in relation to investigations, asset recovery, security, enforcement and claims arising before or during formal insolvency proceedings.

He also advises companies, directors, shareholders and high-net-worth individuals who are facing insolvency-related claims, enforcement action or financial restructuring. This includes considering the validity and enforceability of security, advising on recovery options and helping clients understand their position where business and personal interests are closely connected.

Another area of work is acting for developers, investors and lenders across a wide range of property matters. His work includes acquisitions and disposals, development projects, investment property, finance arrangements and issues arising from the ownership, use or management of commercial property.

For lenders, he advises on security and enforcement, including the creation, review and enforcement of security over property and other assets. He also acts in the recovery of secured and unsecured debts, helping clients assess the most effective route to recover sums due, protect assets and manage risk.

 

His broad experience enables him to identify the commercial, legal and practical issues surrounding a matter, rather than approaching each problem in isolation. He is focused on providing clear, strategic advice and finding proportionate solutions, whether through negotiation, restructuring, enforcement or litigation.
