Michael Turner secures £3.5 million settlement in catastrophic injury case

Michael Turner, Consultant Solicitor at Scott-Moncrieff & Associates Ltd, has specialised in catastrophic injury, clinical negligence and complex personal injury claims for over 35 years.

Working with his team, he recently secured a life-changing £3.5 million settlement, plus costs, for a client seriously injured in a road traffic accident.

THE FACTS

The client, a man in his late 60’s and a lifelong motorcyclist, was riding his motorcycle on a Sunday morning on a country road when he was struck by a part-time delivery driver who had been looking at a map on the passenger seat at the time of the accident.

The collision resulted in serious injuries, including a below-knee amputation of the client’s right leg.

THE CLIENT

The client was approaching retirement, having worked as a support worker for adults with learning disabilities and autism. Outside of work, he was a committed musician, a passionate motorcyclist and a devout Christian. He had also founded and was active in a charity in his son’s name following an earlier personal tragedy.

He lived with his wife who has a severe hoarding disorder (he also had tendencies) in a small, cluttered semi-detached property. The living conditions were not suitable following the accident due to the high risk of the client tripping and falling.

The client demonstrated remarkable determination in his rehabilitation. After an initial period in a wheelchair, he underwent further surgery resulting in a through-knee amputation. This enabled him to be fitted with an advanced prosthetic limb, and with a lot of hard work, he regained a greater level of mobility and independence.

THE CASE

Liability was initially contested. The defendant had stand-alone delivery driver insurance and under the advice of his insurers, pleaded not guilty. 

The client asked to meet the defendant ahead of the court case, where he chose to forgive him. 

The day before the court case, the defendant changed his plea to guilty.

THE OUTCOME

Given the client’s age, the anticipated settlement was around £1 million. However, Michael  Turner and the team secured £3.5 million in damages, together with full recovery of costs.

The claim was carefully structured to reflect the client’s individual circumstances, including his housing needs and the risks presented by his living environment. Provision was also made for ongoing support and treatment for both him and his wife to ensure a safe living environment in the future.

Over the course of the case, which ran for three and a half years, the team also assisted the client in moving from his existing home into a rented bungalow. He has since purchased a new property and a suitable vehicle.
