Scomo consultant Andrew Frederick has been representing the family of Darcy Ross, who died alongside Eve Smith and Rafel Jeanne following a road traffic collision near St Mellons, Cardiff, in March 2023. More than three years after her death, he continues to seek clarity about why she was left undiscovered for almost 48 hours after the crash without the help, dignity, or care she needed and deserved.
It was reported on BBC Wales Today and the BBC News website that on 21 July 2026, Andrew attended Cardiff Magistrates’ Court with Darcy’s family as garage owner Neil Lewis pleaded guilty to fraud by false representation in connection with an MOT certificate issued for the Volkswagen Tiguan involved in the collision.
The court heard that the vehicle had previously been salvaged following a serious collision in Scotland in 2021. It initially failed an MOT in February 2023 after a warning light indicated a possible fault with the seatbelt system, airbags or both.
Lewis subsequently issued an MOT certificate for the vehicle. However, a text message sent to the vehicle’s owner stated that the seatbelt and airbag light still needed to be addressed. Lewis acknowledged during a police interview that the vehicle was dangerous.
The criminal proceedings concern the fraudulent MOT certificate. The wider circumstances surrounding the collision, the search for the missing group and the response of the relevant authorities remain matters of profound importance to the families.
Speaking outside court on behalf of the Ross family, Andrew said that they were pleased that the defendant pleaded guilty and that they have fought for answers for years.
“From the very beginning we raised concerns about the condition of the vehicle and asked for those concerns to be fully investigated.
“Nothing that has happened today changes the devastating reality that we live with every single day.
“Darcy was deeply loved and is missed beyond words. Every day without her is a reminder of the future which she has been denied and the immeasurable loss our family continues to endure.”
